In my previous role, I was the head of an LGBTQ asylum charity, where I worked tirelessly to provide support and guidance to individuals seeking asylum based on their sexual orientation or gender identity. My advocacy efforts did not go unnoticed, as I was interviewed by esteemed media outlets such as Channel 4, Aljazeera, and LBC radio, shedding light on the challenges faced by the LGBTQ community in immigration.

Introduction to LGBT immigration

Immigrating to a new country can be a complex and daunting process, and this is especially true for those in the LGBT community. One area where a specialised LGBT immigration lawyer can be particularly valuable is in same-sex marriage immigration. While many countries now recognise same-sex marriages, the immigration process for same-sex couples can still be complicated. A specialised lawyer can help you understand the specific requirements and documentation needed to prove the validity of your marriage and navigate any potential hurdles that may arise.

How a specialized LGBT immigration lawyer can help with same-sex marriage immigration

Navigating the immigration process as a same-sex couple can be challenging, even in a country like the UK that recognises same-sex marriages. A specialised LGBT immigration lawyer can provide invaluable assistance in this regard. They can help you gather the necessary documentation, such as marriage certificates, joint financial records, and proof of cohabitation, to establish the validity of your marriage.

Additionally, a specialised lawyer can guide you through the application process, ensuring that you meet all the requirements and deadlines. They can help you prepare a strong case, addressing any potential concerns or doubts that the immigration authorities may have. By working with a specialised LGBT immigration lawyer, you can increase your chances of a successful outcome and a smooth transition to your new home.

Questions to ask when choosing an LGBT immigration lawyer

When selecting an LGBT immigration lawyer, it is essential to ask the right questions to ensure that they are the right fit for your specific needs. Here are some questions to consider:

How long have you been practicing LGBT immigration law?

Have you worked on cases similar to mine before?

What is your success rate in handling LGBT immigration cases?

Can you provide references from past clients?

How do you stay updated on changes in LGBT immigration law?

By asking these questions, you can gauge the lawyer’s experience, expertise, and commitment to staying informed about the latest developments in LGBT immigration law. It is crucial to choose a lawyer who not only possesses the necessary knowledge but also demonstrates a genuine understanding of the challenges faced by LGBT immigrants.

Common challenges faced by LGBT immigrants

LGBT immigrants often face unique challenges and barriers that can complicate the immigration process. Some common challenges include:

Lack of recognition: In some countries, same-sex relationships are not legally recognised, making it difficult for LGBT couples to obtain visas or residency based on their relationships.

Discrimination: LGBT immigrants may face discrimination and prejudice during the immigration process, which can impact their applications and overall experience.

Navigating these challenges requires the expertise of a specialised LGBT immigration lawyer who understands the unique obstacles faced by LGBT immigrants and can advocate for their rights throughout the immigration process.

Conclusion: Why working with a specialised LGBT immigration lawyer is crucial

Navigating the complexities of LGBT immigration requires specialised knowledge and expertise. By working with a specialised LGBT immigration lawyer, you can ensure that your rights are protected and that you have the necessary support throughout the immigration process. They understand the unique challenges faced by LGBT immigrants and can provide guidance and representation tailored to your specific needs.

Whether you are applying for a visa, or dealing with same-sex marriage immigration, a specialised LGBT immigration lawyer can be your advocate and ally. They have the experience and knowledge to navigate the intricate web of LGBT immigration law, ensuring that your case is handled with care and expertise.

One of the most common visas we can support you with is the family visa. This is necessary for you to bring your family into the UK. Examples include partner visas for married/civil partnered, couples (those who have lived together for a continuous period of at least two years), fiancés, and those with dependent children. The most common problem we encounter in these cases is the financial requirement, which stipulates that to be eligible you must have at least a gross annual income of at least £18,600 (though this is dependent on exceptions such as permitted benefits). Working out the amount needed can become complicated, especially when children are involved. The Home Office document which covers this is Appendix FM and currently has 71 pages! However, we are here to help explain the requirements to you.

A very common visa is the visitor visa that is used when you are travelling to the UK for leisure or business, or maybe even healthcare. However, getting the evidence together to show that the Home Office that you won’t be a risk or overstay can be difficult. A helpful tool is on the UK government’s website to check the visa requirements:

There are lots of different names for this visa used by people, including permanent residency. You can generally apply for this after having lived in the UK for a specific period of time. The period of time depends on the visa that you are on. There are lots of advantages of having permanent residency, which includes being free of immigration control and also not having to pay the Immigration Health Surcharge each year!

When applying you need to be aware of the visa requirements such as the Life in the UK test. There are numerous steps to take and eligibility criteria to meet, which can be very daunting. We are here to help you understand this process and ensure it is done properly. Do not hesitate to contact us for further information and support.

Now that the UK has left the EU, there are lots of changes. At No Going Back we ensure that we are up to date on all legislative changes that may affect EU nationals applying to come and live in the UK.

Case study: Raj & Sunny

Raj and Sunny, a same-sex couple, had their fair share of challenges in their immigration case. They first connected on a gay dating site and quickly developed a strong bond. Raj, a British national, decided to take a leap of faith and travelled to India to meet Sunny in person. However, their happiness was short-lived when Sunny’s visit visa application was rejected by the Home Office, citing concerns about his intentions to return to India.

This rejection put a considerable strain on their relationship. Despite the distance and the uncertainties ahead, Raj was determined to make their love prevail. During his second visit to India, Raj mustered up the courage and proposed to Sunny, hoping to solidify their commitment to each other.

Realising the complexities of their situation, Raj reached out to an LGBT immigration lawyer in the UK to seek guidance and explore their options. The lawyer, understanding the unique challenges faced by same-sex couples in immigration matters, immediately scheduled a three-way conversation to discuss their case comprehensively.

Taking into account the time frames and Sunny’s employment contract in India, the lawyer developed an immigration plan. They guided Raj and Sunny through the process of obtaining a fiancé visa, providing them with the necessary legal support and advice at every step. The lawyer’s expertise and experience in navigating the intricacies of UK immigration law proved invaluable to the couple.

With the lawyer’s unwavering support, Sunny successfully obtained the fiancé visa, allowing him to join Raj in the UK. Throughout the entire process, the lawyer remained by their side, ensuring that all the legal requirements were met and addressing any concerns that arose.

The lawyer’s commitment to their case extended beyond the initial visa application. They continued to assist Raj and Sunny as they worked towards Sunny’s permanent residency and eventual acquisition of a British passport. The lawyer’s knowledge and expertise proved instrumental in overcoming the hurdles of UK immigration law.

Beyond their professional relationship, the lawyer also played a crucial role in building a strong client relationship with Raj and Sunny. They provided emotional support, understanding the unique challenges faced by same-sex couples in immigration matters, and going above and beyond to ensure the couple’s happiness and well-being.

Ultimately, Raj and Sunny’s love triumphed over the immigration obstacles they faced. With the legal guidance and unwavering support of their dedicated LGBT immigration lawyer, they were able to navigate the complexities of the UK immigration system and build a life together in the UK. Their story serves as a testament to the power of love and the importance of having the right legal advocate by your side in times of uncertainty.
